1) Scope of application
1.1 These general conditions of contract (hereinafter "General Conditions") of Eco-Global-Art.com (hereinafter "seller"), apply to all contracts entered into by a consumer or professional (hereinafter "customer") with the seller , in reference to the goods and/or services for sale in the seller's online store. These conditions exclude the application of the customer's own provisions, unless otherwise agreed.
1.2 For the purposes of these General Conditions, "consumer" means any person (individual or legal) who enters into a legal transaction for purposes that do not fall within the scope of their commercial or independent professional activity. "Professional" means any natural or legal person or company with legal personality who, in concluding a legal transaction, acts for purposes attributable to their independent commercial or professional activity.
2) Completion of the contract
2.1 Product descriptions in the seller's online shop constitute binding offers by the seller.
2.2 The customer can accept the offer via the order form in the seller's online shop. If the order is placed via the online order form, after entering personal data, the customer, by clicking on the validation button at the end of the purchase procedure, provides the legally binding acceptance of the contractual offer in relation to the goods contained in your shopping cart. However, the offer can only be accepted if the customer, by checking the corresponding box under the text: "I expressly declare that I have read and accept the general conditions of sale", confirms that he accepts the contractual conditions.
2.3 The seller sends an order confirmation by email to the customer.
2.4 In case of acceptance of an offer via the seller's online order form, the contractual text will be saved by the seller and sent to the customer after sending the respective order, together with the text of the general conditions (eg by e-mail, fax or letter). The contractual text will also be archived on the seller's website and the customer will be able to access it free of charge through his password-protected account by entering the relevant login data, provided that, before sending the order, the customer has created an account in the store online from the seller. In any case, the seller will send the customer an order confirmation, signaling the possibility of downloading and printing the general terms and conditions using the "print" function.
2.5 Before submitting the binding order via the seller's online order form, the customer can correct his data at any time using normal mouse and keyboard functions. Furthermore, before the mandatory transmission of the order, all data will be displayed in a confirmation window, where they can still be changed using normal mouse and keyboard functions.
2.6 If the customer acts as a consumer, the only language available to stipulate the contract is portuguese.
3) Right to cancel the purchase
3.1 Consumers have the right to declare the reversal of the purchase due to repentance within 7 days of receipt of the product or service. Cancellation must be communicated in writing.
3.2 For more information on the right of withdrawal, please refer to the related information in Art. 49 of the Consumer Protection Code.
4) Prices and payment terms
4.1 Products shipped from Brazil or Italy will be charged the applicable sales tax. It is already included in the prices.
Sales tax is generally not levied on purchases from countries outside the EU or Brazil, although it can sometimes be levied on importation.
4.2 Shipping fees by DHL, Post Office or any other carrier will be visible in the cart before finalizing the order.
4.3 Shipments to countries outside the European Union may incur additional specific costs to be borne by the customer. These include taxes and import charges (eg customs charges).
4.4 The customer has several payment options available: Credit and debit cards and bank transfer.
5) Delivery and shipping conditions
5.1 The goods are shipped by carrier to the address indicated by the customer.
5.2 If the courier sends the goods back to the seller due to the impossibility of delivering to the customer, the costs of the unsuccessful shipment will be charged to the customer.
6) Legal guarantee of conformity
6.1 The provisions of the law apply in cases of warranty for defects in the thing sold.
6.2 Claims for damage assume that the buyer informs the seller of the damage within five days of receipt.
7) Severability clause
In the event that any term of this agreement is held invalid or unenforceable by court order or decision, the remainder of this agreement will remain valid and enforceable.
